Telecommunications wholesaler AAPT has settled a dispute with dark fibre provisioning company, Digital River Networks, out of court, with each party bearing their own proceeding costs.
The case was set for first directions this morning (3 September) to be held at the Federal Court of NSW under Justice Robert Buchanan, but was taken off court listings at last minute due to the settlement.
The proceedings were first brought against Digital River Networks by AAPT on 30 July.
Justice Buchanan granted leave to both parties yesterday, ordering AAPT as applicant to pay $8100 to cover court costs of the Telecommunications Industry Ombudsman, who would have acted as second respondent to the proceedings.
Neither party would discuss the value of the settlement or the origin of the dispute.
Digital River Networks provides dark fibre, ethernet, internet and inter-capital services to companies. However, the company’s website is currently under maintenance, and a live version of the website currently displays no information.
