Telstra submits final separation undertaking

The ACCC will move to make its final decision as soon as possible

Telstra has submitted its final revised Structural Separation Undertaking (SSU) to the Australian Competition and Consumer Commission (ACCC) in the last step in cementing its role in the National Broadband Network (NBN).

Telstra chief executive, David Thodey, said the document responded to a number of concerns put forward by the ACCC following the multiple rounds of public consultation.

“I am pleased the ACCC has acknowledged that their concerns have been addressed and I note their commitment to consider the SSU promptly,” Thodey said in a statement.

Changes made to the revised SSU, initially lodged in December, include clarification on the operation of the overarching equivalence commitment, and also how wholesale customers access reference prices for regulated services, which had been a source of contention among competing telcos.

The ACCC does not intend to consult further on the revised SSU with ACCC chairman, Rod Sims, indicating it will move to finalise its decision as soon as possible.

“This further version addresses those drafting issues raised during the recent consultation process that were of concern to the ACCC,” Sims said.

According to the telco, the changes made to the SSU since it was lodged in July would not constitute a change in the context of the transaction new Telstra shareholders approved in October.
