Minardi Pty Limited, which owns Melbourne nightclub Brown Alley, has been fined $15,000 for sending promotional SMS messages that did not comply with the Spam Act.
An investigation by the Australian Communications and Media Authority (ACMA) found some of the messages had no contact details while others did not have an opt-out function. Some messages had neither.

An ACMA spokesperson said that under the Spam Act, all promotional SMS messages must contain information to help consumers contact the business and an option to unsubscribe.
“Not only is it a requirement of the Act, but including contact details in marketing messages makes it easier for customers to contact businesses, promoting customer satisfaction and a positive reputation,” the spokesperson said.
